a. The combined net incomes of the parent’s are found on the child support schedule and a total number of child support is determined, based on the number and ages of the children. This number is then divided according to the proportionate share of income between the parties.
The non-residential parent would then be responsible to transfer their proportional share of child support to the residential parent either directly or through the Division of Child Support. Generally, the child support amount can be argued up or down either way, but the court has a strong bias to accept the numbers generated by the state mandated formulas.
If the parties are seeking an uncontested divorce and desire to deviate from the standard child support calculation, our attorneys can assist in filing the necessary documents that will be approved by the court.
Health care, tax credits, travel, and other child related expenses will also become part of the child support order depending on the circumstances of the party.
What if I need to modify my child support later?
Modifications are allowed to child support orders upon a showing of a substantial change in circumstances or if the last support order was entered more than three years ago, or less under certain particular circumstances.
